OTC Mall and Logistics or “we” operates an e-commerce platform consisting of a website and marketplace, together with supporting logistics and payment infrastructure, for the sale and purchase of consumer products in Ghana (“territory”).
These general terms and conditions shall apply to buyers and sellers on the marketplace and shall govern your use of the marketplace and related services.
By using our marketplace, you accept these general terms and conditions in full.
If you use our marketplace in the course of a business or other organizational project, then by so doing you:
confirm that you have obtained the necessary authority to agree to these general terms and conditions;
bind both yourself and the person, company or other legal entity that operates that business or organizational project, to these general terms and conditions; and
agree that “you” in these general terms and conditions shall reference both the individual user and the relevant person, company or legal entity unless the context requires otherwise.
Registration and account
You may not register with our marketplace if you are under 18 years of age
You may register for an account with our marketplace by completing and submitting the registration form on our marketplace.
You represent and warrant that all information provided in the registration form is complete and accurate.
If you register for an account with our marketplace, you will be asked to provide an email address/user ID and password and you agree to:
keep your password confidential;
notify us in writing immediately (using our contact details provided at section 23) if you become aware of any disclosure of your password; and
be responsible for any activity on our marketplace arising out of any failure to keep your password confidential, and that you may be held liable for any losses arising out of such a failure.
Your account shall be used exclusively by you and you shall not transfer your account to any third party. If you authorize any third party to manage your account on your behalf this shall be at your own risk.
We may suspend or cancel your account, and/or edit your account details, at any time in our sole discretion and without notice or explanation, providing that if we cancel any products or services you have paid for but not received, and you have not breached these general terms and conditions, we will refund you in respect of the same.

By accessing Otcmallgh.com, which is operated by Otc Mall and Logistics, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with these Terms and Conditions, you must not apply for or use any of the services provided by this site. The materials contained in this web site are protected by applicable copyright and trade mark law.
Your Responsibilities
You are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must immediately notify OTCmall of any unauthorized uses of your account or any other breaches of security. OTCmall will not be liable for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions. Otcmall is committed to protecting the integrity and security of your data but Otcmall shall not be responsible or liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Otcmallandlogistics.com.
User Transactions
Otcmall shall not be responsible or liable for any of the transactions between you and any of our resellers or users. You must immediately notify Otcmall of any fraudulent transaction, encountered with any of our resellers or users.
Account Termination
Your Otcmall Membership may be terminated at any time, with or without cause, with or without notice. Your membership or subscription shall automatically be terminated if you violate any of these restrictions.
Notifications
Notices by the Site (Otcmallgh.com) to you may be given by means of electronic messages through the Site (Otcmallgh.com), by a general posting on the Site, by forum messages, or by conventional mail.
Change of Services
OtcMall and Logistics reserves the right to change the service, delete, or add features at any time and for any reason.
Changes to Terms and Condition policies
From time to time we may make adjustments to this policy. Changes will be made at our sole discretion. Site users are encouraged to check this policy for such changes. Your continued use of this site following changes to this policy constitutes your acceptance of the changes. Otcmall and Logistics recommends that you review this page from time to time to note any changes. In addition, when you use any current or future Otcmall and Logistics service or business, you will also be subject to the guidelines, terms, and agreements applicable to such service or business.
Disclaimer of Warranties
Under no circumstances shall OtcMall and Logistics be held liable to any user, for any direct or indirect damages that may arise due to “downtime” and/or availability of the Site or the Site’s systems. Further, OtcMall and Logistics does not warrant, guaranty, or make any representations concerning the accuracy, timeliness, quality, availability, security, completeness, reliability,error-free, of the content, or any service provided.

Sales or promotion of beer or hard alcohol
Sales or promotion of tobacco or tobacco-related products
Sales or promotion of prescription drugs
Sales or promotion of sexually explicit materials (pornography)
Sales or promotion of promote violence
Account Funding & Withdrawal
The default currency used on the OtcMall and Logistics platform is the Ghana Cedis. You can fund your OtcMall account wallet using either mobile money, or bank transfer.
Mobile Money: When funding your account through Mobile Money (momo), always make sure that you record the transaction id for future reference. Note, that it takes 24 to 48 hours before your account will be credited.
Bank Transfer: Bank transfer account top-up takes 24 to 48hours before your account will be credited.
Fund Withdrawal
Fund withdrawal takes between 2 tom 10 days to be processed. The exchange rate used during withdrawal depends on the method you used when making the payment. If you have paid through Mobile Money,we will use the default withdrawal exchange rate set on the system. However, if you have paid through bank transfer, the rate at the moment of your payment will be used as the withdrawal rate.
Not that “default withdrawal rate” is different from current withdrawal rate.
Fees and Services
Registration on OTCMall is free. We do charge 10% for procurement service while shipping charges are based on the KG/SIZE of the item. We may change our Fees and Credits Policy and the fees for our services from time to time. We may in our sole discretion change some or all of our services at any time. In the event, we introduce a new service, the fees for that service are effective at the launch of the service. You are responsible for paying all fees associated with using our service and the Site and all applicable taxes. OTCMall may from time-to-time review and change how members can access the site. Such changes will be posted on the site and shall become binding on all members upon its implementation.
Third-party Links & Advert Display
OTCMALL AND LOGISTICS may provide links to third-party websites or resources. You acknowledge and agree that OTCMALL AND LOGISTICS is not responsible for the availability of such external sites or resources, and does not endorse and not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. OTCMALL AND LOGISTICS shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

All local vendors(sellers) being bought by a customer will be confirmed in 24 hours.
Product Displayed on OTCMALL AND LOGISTICS
OtcMall and logistics is a procurement and shipping agent. Products being displayed on OtcMall and Logistics website are retrieved from third-party shopping platforms, Individual vendors selling on our platform, and are not directly sold by us. Thus, in case of any issue involved by the aforesaid products, all liabilities incurred shall be borne by the corresponding sellers on the third-party platform. Thus, we will not undertake any relevant, collateral, or joint liability.
Product content & price: We cannot guarantee the accuracy of product information displayed on our website, including price, domestics shipping fee, and stock availability as well as the quality of the said product. All price of items does not include service fee & international shipping fee yet.
Shipping Restrictions: We reserve the right to change or disallow certain international shipping methods for items that are prohibited due to certain conditions, including, but are not limited to their length, volume, weight, or if the product bears the logo of international brands. We shall not be held liable or responsible if the items you purchased cannot be delivered to you due to the operation of law or regulations or other factors beyond our reasonable control. You must comply with all customs laws and regulations and other applicable laws. You will be responsible if anything is imported into your destination country in contravention of such laws.
